Congress just gave the hemp industry a 29-day reprieve before a federal ban takes effect Dec. 11. Don’t mistake that for good news. The supply chain is already adjusting, since nothing in this business moves that fast. Raw materials take months to order, and manufacturing time takes 90 days to book. The new rules would redefine hemp so strictly that most products on shelves at places like Target would legally count as marijuana. That’s pushing an estimated $38.7 billion industry to reformulate products, cut inventory, or shut down.
The common backup plan is pivoting to functional beverages that skip hemp entirely. Companies like Upstate Elevator and Torch Drinks are already doing it, betting on botanicals instead of THC. Not everyone is playing defense. Kick Beverage Co. is actually expanding, launching a new drink this fall, helped by the fact that it isn’t sitting on millions in unsold inventory.
Some see a silver lining. The extension itself is being read as a sign that Congress wants to regulate hemp rather than ban it outright. For now, operators are planning for the ban while hoping for regulation instead.
